My husband has defaulted on his IVA by not selling all assets within the length of his term. Our advisor has said that bankruptcy is the next step and that the properties my husband owns although they are in negative equity may be taken as there is a surplus amount each month which pays our own mortgage. Here is were I am confused the advisor has said that my husband is still aloud to make an income to live in the life that he is accustomed to, so with his only income being what he makes off the rental income and a small amount of sickness benefit as he has arthritis in his spine will the properties still be taken??? We live in Northern Ireland is the rules of Bankruptcy any different to mainland UK our advisor isn't helpful in my opinion and don't know if we should move to someone else this far down the road....
